Types of Personal Information we collect and how we collect it

Personal Information: This policy covers the following personal information that Treeminer collects through your use of the Treeminer Web sites and in connection with off-line communications. Specifically, Treeminer may collect this information from offline and online registrations and forms, communications and interactions, and sales inquiries and transactions. Treeminer also may use third party sources, such as opt-in lists, as specified below.

Contact information, such as name, physical address, telephone number(s), email address, and company. The majority of the information collected under this category is business contact information.

User preferences, such as product requirements, areas of industry interest, newsletters, community choices and other information you select in the customer profile when registering on Treeminer.com or indicated by your use of the Treeminer.com Web sites.

Event and conference participation information, such as lectures, classes or booths attended or visited during an event or conference hosted or attended by Treeminer. If we use electronic tracking technologies at an event, we will provide notice in the event registration materials and/or correspondence.

Electronic Communications Protocols and Cookies:

In addition to the information specified above, Treeminer may collect information about your use of the Treeminer.com Web sites through electronic communications protocols and cookies. As is true when you visit most Web sites, Treeminer may automatically receive information from you as part of the communication connection itself, which often consists of network routing information (where you came from), equipment information (browser type), your IP address, and date and time. Treeminer also uses cookies, embedded URLs and embedded pixels to capture additional information.

Cookies:

Treeminer's server will query your browser to see if there are "cookies" previously set by the Treeminer Web sites. A cookie is a small piece of information sent by a Web server to store on a Web browser so it can later be read back from that browser. Cookies on the Web sites may collect a unique identifier, user preferences and profile information and membership information. Treeminer also uses cookies to collect general usage and volume statistical information that does not include personally identifiable information. Some cookies may remain on the user's computer after they leave the Web site, and the majority are set to expire within 30 365 days. While we do not offer an opt-out for cookies, browsers provide you information and control over cookies. You can set your browser to alert you when a cookie is being used, and accept or reject the cookie. You can also set your browser to refuse all cookies or accept only cookies returned to the originating servers. USE AND SHARING OF PERSONAL INFORMATION

Treeminer uses (and, where specified, shares) your personal information for the following purposes:

To engage in transactions. Treeminer may use personal information such as name, physical address, telephone number, email address, and company to engage in transactions with you, including contacting you about your order.

To provide support or other services. Treeminer may use your personal information to provide you support or other services you have ordered, as well as product updates, product patches and fixes and other similar communications.

To tailor marketing to your needs and respond to your requests. Treeminer may use your personal information to notify you about new product releases and service developments. Treeminer also may use your personal information to respond directly to your requests for information, including registrations for newsletters or other specific requests, or pass your contact information to the appropriate Treeminer distributor or reseller for further follow-up related to your interests. In addition, if you consent, Treeminer may share your contact information with other selected partners that offer complementary products or services. Please review the specific partner's privacy policy regarding any further interactions with them.

To provide online forums and social networks. Some services available on the Web sites permit you to participate in interactive discussions, post comments, opportunities or other content to a bulletin board or exchange, or otherwise engage in networking activities. Some of these services are moderated; all may be accessed for technical reasons. Treeminer does not control the content that users post to these forums or social networks. You should carefully consider whether you wish to submit personal information to these forums or social networks and should tailor any content you submit appropriately and in accordance with the relevant terms of use. In addition, you should review any additional terms and conditions that may govern your use of these services, including terms related to use, sharing your personal information and receiving communications; any such terms will be clearly identified on the relevant site.

To post Testimonials. We post testimonials on our web site which may contain personal information. Prior to posting the testimonial, we obtain the customer's consent to post their name along with their testimonial.

To administer product downloads. Treeminer may contact you if you download products to confirm certain information about your order (for example, that you did not experience problems in the download process), discuss the downloaded products or provide marketing or sales information about related products and services. Treeminer also may use this information to confirm compliance with licensing and other terms of use and may share it with your company.

To select content, improve quality and facilitate use of the Web Sites. Treeminer may use your personal information, including the information gathered as a result of site navigation and electronic protocols and cookies (including third party cookies), to help create and personalize Web site content, facilitate your use of the Web sites (for example, to facilitate navigation and the login process, avoid duplicate data entry, enhance security, keep track of shopping cart additions and preserve order information between sessions), improve Web site quality, track marketing campaign responsiveness, and evaluate page response rates.

To power joint sales or product promotions. Treeminer and its partners may engage in joint sales or product promotions. Such promotions will always reference the partners involved. Both Treeminer and the partner(s) will have access to that information, and either Treeminer or our partners may provide you the sales or product promotion information. We recommend you review the privacy policies of these partners to address your particular needs and concerns.

To communicate with you about a conference or event. We or our partners may communicate with you about a conference or event hosted or co-sponsored by Treeminer or one of our partners. This may include information about the event's content, event logistics, payment, updates, and any additional meetings, special demonstrations or other customer facilitation that we may provide related to an event for which you have registered. Treeminer may contact you after the event about the event and related products and services and may share information about your attendance with your company. Treeminer also will permit designated partners or conference sponsors to send you up to two communications through the services of a third-party bonded warehouse. Please note that our partners or conference sponsors may directly request your personal information at their conference booths or presentations; providing your information is optional, and you should review their privacy policies to address your particular needs and concerns.

To comply with legal requirements. Treeminer may be required to disclose your personal information in order to comply with legally mandated reporting, disclosure or other legal process requirements. Treeminer will use reasonable efforts to limit the personal information it provides for these purposes.

Please note that your personal information may be transferred, accessed and stored globally as necessary for the uses stated above in accordance with this policy. While Treeminer may share your personal information with agents and contractors in order to perform the functions listed above, including order fulfillment, and event, campaign and web site management, we require that they treat your personal information, and limit its use, in accordance with the standards specified in this policy.

REGISTRATION, CUSTOMIZATION, PREFERENCES AND OPT-OUT

Treeminer allows you to establish an online registration profile for marketing communications at Treeminer.com. You may use the profile to customize and control your preferences for receiving electronic information, including opting into (or out of) newsletters and general interest areas.

Opting Out:

Treeminer.com enables you to opt out of marketing communications. You may opt out of email marketing by using our general unsubscribe automated link that is included in Treeminer marketing emails.

Some non-marketing communications are not subject to general opt-out, such as communications related to product download, sales transactions, software updates and other support related information, patches and fixes, quality assurance surveys, conferences or events for which you have registered, and disclosures to comply with legal requirements, as well as communications with partners, including product alerts, updates, marketing and sales materials and other notices related to partner status.

Information-Sharing Choices:

Treeminer only shares personal information with selected companies after providing users the ability to either opt out of or opt into the sharing. There are limitations to opting out of such sharing in the case of joint sale or joint events where the data goes to both Treeminer and the other party at the same time where the customer has requested follow-up which involves Oracle partners where third parties are required to accomplish the transaction or perform the service Third Party Permission-Based Lists. On occasion, Treeminer may use third-party lists to send communications about Treeminer products and services. These lists, which are maintained by third parties, include users eligible under applicable law to receive emails from other companies such as Treeminer. When we use such lists, the communications will include mechanisms to opt out of Treeminer marketing communications and the third party lists. If you have trouble opting out, or if you wish to make us aware of any issues related to a third-party mailing, you may contact us directly at privacy@treeminer.com.

SECURITY

The security of your personal information is very important to Treeminer We have in place physical, administrative and technical safeguards designed to protect your personal information from unauthorized access.

In the event that your personal information is acquired, or is reasonably believed to have been acquired, by an unauthorized person and applicable law requires notification, Treeminer will notify you of the breach by email, fax, or U.S. mail. Treeminer will give you notice promptly, consistent with the reasonable needs of law enforcement and/or Treeminer to determine the scope of the breach and to investigate and restore the integrity of the data system.

POLICY UPDATES

We may update this policy from time to time. We will post a prominent notice in this section of this policy notifying users when it is updated. If we are going to use your personal information in a manner different from that stated at the time of collection, we will notify you via email, and you will have a choice as to whether or not we use your personal information in this different manner.

Welcome to the Treeminer Web sites (the "Site"). Through the Site, you have access to a variety of resources and content. These include: (a) software and software as a service offerings ("Software"); (b) Web pages, data, messages, text, images, photographs, graphics, audio and video such as podcasts and Webcasts, and documents such as press releases, white papers and product data sheets ("Materials"); and (c) forums, discussion groups, chat areas, bulletin boards, blogs, wikis, e-mail functions, and other services in connection with which you can upload, download, share, email, post, publish, transmit or otherwise access or make available Content (as defined below) ("Community Services"). 1. 4. Use of Community Services Community Services are provided as a convenience to users and Treeminer is not obligated to provide any technical support for, or participate in, Community Services. While Community Services may include information regarding Treeminer products and services, including information from Treeminer employees, they are not an official customer support channel for Treeminer.

You may use Community Services subject to the following: (a) Community Services may be used solely for your personal, informational, noncommercial purposes; (b) Content provided on or through Community Services may not be redistributed; and (c) personal data about other users may not be stored or collected except where expressly authorized by Treeminer.

5. Reservation of Rights The Site and Content provided on or through the Site are the intellectual property and copyrighted works of Treeminer or a third party provider. All rights, title and interest not expressly granted with respect to the Site and Content provided on or through the Site are reserved. All Content is provided on an "As Is" and "As Available" basis, and Treeminer reserves the right to terminate the permissions granted to you in Sections 2, 3 and 4 above and your use of the Content at any time.

6. Your Content You agree that you will only upload, share, post, publish, transmit, or otherwise make available ("Share") on or through the Site Content that you have the right and authority to Share and for which you have the right and authority to grant to Treeminer all of the licenses and rights set forth herein. By Sharing Content, you grant Treeminer a worldwide, perpetual, royalty-free, irrevocable, nonexclusive, fully sublicensable license to use, reproduce, modify, adapt, translate, publish, publicly perform, publicly display, broadcast, transmit and distribute the Content for any purpose and in any form, medium, or technology now known or later developed. This includes, without limitation, the right to incorporate or implement the Content into any Treeminer product or service, and to display, market, sublicense and distribute the Content as incorporated or embedded in any product or service distributed or offered by Treeminer without compensation to you. You warrant that: (a) you have the right and authority to grant this license; (b) Treeminer's exercise of the rights granted pursuant to this license will not infringe or otherwise violate any third party rights; and (c) all so-called moral rights in the Content have been waived to the full extent allowed by law.

You agree that you will not Share any Content that: (a) is binary executable code; (b) is false or misleading; (c) is defamatory, derogatory, degrading or harassing of another or constitutes a personal attack; (d) invades another's privacy or includes another's confidential, sensitive or personal information; (e) promotes bigotry, racism, hatred or harm against any group or individual; (f) is obscene or not in good taste; (g) violates or infringes or promotes the violation or infringement of another's rights, including intellectual property rights; (h) you do not have the right and authority to Share and grant the necessary rights and licenses for; (i) violates or promotes the violation of any applicable laws or regulations; (j) contains a solicitation of funds, goods or services, or promotes or advertises goods or services; or (k) contains any viruses, Trojan horses, or other components designed to limit or harm the functionality of a computer.

Treeminer does not want to receive confidential information from you through or in connection with the Site. Notwithstanding anything that you may note or state in connection with Sharing Content, it shall not be considered confidential information and shall be received and treated by Treeminer on a non-confidential and unrestricted basis.

7. Security, Passwords and Means of Accessing the Site and Content You agree not to access or use the Site in any manner that could damage, disable, overburden, or impair any Treeminer accounts, computer systems or networks. You agree not to attempt to gain unauthorized access to any parts of the Site or any Treeminer accounts, computer systems or networks. You agree not to interfere or attempt to interfere with the proper working of the Site or any Treeminer accounts, computer systems or networks. You agree not to use any robot, spider, scraper or other automated means to access the Site or any Treeminer accounts, computer systems or networks without Treeminer's express written permission.

Access to and use of password protected or secure areas of the Site is restricted to authorized users only. You agree not to share your password(s), account information, or access to the Site. You are responsible for maintaining the confidentiality of password(s) and account information, and you are responsible for all activities that occur under your password(s) or account(s) or as a result of your access to the Site. You agree to notify Treeminer immediately of any unauthorized use of your password(s) or account(s).

8. No Unlawful or Prohibited Use You agree not to use the Site or Content provided on or through the Site for any purpose that is unlawful or prohibited by these Terms of Use, or the rules, guidelines or terms of use posted for a specific area of the Site or Content provided on or through the Site.

9. Indemnity You agree to indemnify and hold harmless Treeminer, its officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys' fees and costs, due to or arising out of Content that you Share, your violation of the Terms of Use or any additional rules, guidelines or terms of use posted for a specific area of the Site or Content provided on or through the Site, or your violation or infringement of any third party rights.

10. Monitoring Treeminer has no obligation to monitor the Site or screen Content that is Shared on or through the Site. However, Treeminer reserves the right to review the Site and Content and to monitor all use of and activity on the Site, and to remove or choose not to make available on or through the Site any Content at its sole discretion.

11. Termination of Use Treeminer may, in its sole discretion, at any time discontinue providing or limit access to the Site, any areas of the Site or Content provided on or through the Site. You agree that Treeminer may, in its sole discretion, at any time, terminate or limit your access to or use of the Site or any Content. Treeminer will terminate or limit your access to or use of the Site if, under appropriate circumstances, you are determined to be a repeat infringer of third party copyright rights. You agree that Treeminer shall not be liable to you or any third-party for any termination or limitation of your access to or use of the Site or any Content.

12. Third Party Web Sites, Content, Products and Services The Site provides links to Web sites and access to Content, products and services of third parties, including users, advertisers, affiliates and sponsors of the Site. Treeminer is not responsible for third party Content provided on or through the Site and you bear all risks associated with the access and use of such Web sites and third party Content, products and services.

13. Disclaimer EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE, THE SITE, AND ALL CONTENT PROVIDED ON OR THROUGH THE SITE, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TREEMINER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE SITE AND ALL CONTENT PROVIDED ON OR THROUGH THE SITE. Any personal information collected on this Site may be accessed and stored globally and will be treated in accordance with Treeminer's Privacy Policy.

17. Note About Minors *Minors are not eligible to use the Site, and we ask that they do not submit any information to us.

18. Export Restrictions/Legal Compliance You may not access, download, use or export the Site, or the Content provided on or through the Site, in violation of U.S. export laws or regulations, or in violation of any other applicable laws or regulations. You agree to comply with all export laws and restrictions and regulations of any United States or foreign agency or authority, and not to directly or indirectly provide or otherwise make available the services and products of Treeminer in violation of any such restrictions, laws or regulations, or without all necessary approvals, including, without limitation, for the development, design, manufacture or production of nuclear, chemical or biological weapons of mass destruction and of missile technology. As applicable, you shall obtain and bear all expenses relating to any necessary licenses and/or exemptions with respect to your own use of the services of Treeminer outside the U.S. Neither the services of Treeminer nor the underlying information or technology may be downloaded or otherwise provided or made available, either directly or indirectly, (a) into Cuba, Iran, North Korea, Sudan, Syria or any other country subject to U.S. trade sanctions, to individuals or entities controlled by such countries, or to nationals or residents of such countries other than nationals who are lawfully admitted permanent residents of countries not subject to such sanctions; or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals and Blocked Persons or the U.S. Commerce Department's Table of Denial Orders. By agreeing to these Terms of Use, you agree to the foregoing and represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.

Applicable Laws All matters relating to your access to, and use of, the Site and Content provided on or through or uploaded to the Site shall be governed by U.S. federal law or the laws of the State of Maryland. Any legal action or proceeding relating to your access to, or use of, the Site or Content shall be instituted in a state or federal court in Montgomery County, Maryland. You and Treeminer agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
